Terms and Conditions — ArtX Gallery

These Terms and Conditions govern your use of art-x.gallery (the "Site") and your participation in exhibitions, open calls, and awards organized by ArtX Gallery ("ArtX Gallery," "we," "us"), located at 43008 Christy Street, Fremont, CA 94538. By using the Site or submitting work to an open call, you agree to these terms.

1. Use of the Site

You may browse the Site and share links to it for personal, non-commercial purposes. You may not copy, scrape, reproduce, or redistribute images or text from the Site without permission, or use the Site in any way that is unlawful or interferes with its operation.

2. Intellectual Property

Artworks shown on the Site remain the property of their respective artists and are protected by copyright. ArtX Gallery's name, logo, text, and design are the property of ArtX Gallery. Nothing on the Site grants you any license to use these materials without written permission from the rights holder.

3. Open Call Submissions

Eligibility: Entrants must be 18 or older and meet the requirements stated on each open call page.
Originality: By submitting, you confirm that you are the creator of the work, that it is original, and that it does not infringe the copyright, trademark, privacy, or other rights of any third party. Works found to violate this will be disqualified, and any award will be withdrawn.
Content: We may decline any submission at our discretion, including work that does not meet the stated theme, technical requirements, or content guidelines.
Jury decisions: Selection and award decisions are made by the jury and are final.

4. Entry Fees and Payment

Entry fees are stated on each open call page and are paid online through Stripe, our third-party payment processor.
Entry fees cover the cost of jury review and administration. They are non-refundable and do not guarantee selection or an award.
If ArtX Gallery cancels an open call before jury review, entry fees for that open call will be refunded in full.

5. License to Use Submitted Work

Artists keep full copyright in their work. By submitting, you grant ArtX Gallery and its co-organizers a non-exclusive, royalty-free license to reproduce images of your submitted work, along with your name, biography, and statements, for the purposes of the exhibition and its promotion. This includes the Site, online exhibitions, ArtX Magazine, press releases, social media, and printed materials. Artists will always be credited, and we will not sell reproductions of your work.

6. Sales

If you choose to list a sale price, interested buyers may be connected with you through ArtX Gallery. Unless otherwise agreed in writing for a specific exhibition, the full proceeds of any sale go to the artist. Artists are responsible for any taxes, shipping, and delivery arising from a sale.

7. Changes to Exhibitions

We may change exhibition dates, formats, jurors, or award categories when necessary. Any material change will be posted on the relevant open call page and communicated to affected artists by email.

8. Disclaimer and Limitation of Liability

The Site is provided "as is." We do our best to keep information accurate and the Site available, but we make no guarantees that it will be error-free or uninterrupted. To the fullest extent permitted by law, ArtX Gallery is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in an open call. Our total liability for any claim relating to an open call is limited to the entry fee you paid for that open call.

9. Links to Other Sites

The Site may link to third-party services such as Stripe. We are not responsible for the content or practices of those services.

10. Governing Law

These terms are governed by the laws of the State of California, USA. Any dispute will be handled in the courts located in Alameda County, California.

11. Changes to These Terms

We may update these terms from time to time. The "Last updated" date above shows when they were last changed. Continued use of the Site or participation in an open call after an update means you accept the revised terms.
